Activity and risks
I am voluntarily participating in the 5K4Good Charity Run and Walk. The event may include running, jogging, walking, warming up, cooling down, gathering at the event site, and using the designated route. I understand that participation may cause property damage, illness, serious injury, permanent disability, or death. Risks include:
- uneven, wet, slippery, muddy, obstructed, or hazardous trails, pathways, roads, curbs, grass, and park surfaces;
- heat, cold, rain, wind, reduced visibility, and changing weather or route conditions;
- physical exertion, fatigue, dehydration, overexertion, cardiovascular events, and aggravation of known or unknown medical conditions;
- contact or collisions with participants, volunteers, spectators, members of the public, bicycles, vehicles, animals, objects, or event equipment; and
- crowding, equipment failure, delayed medical assistance, the acts or omissions of others, and other risks associated with a public running or walking event.
Assumption of risk
I freely accept and assume all risks associated with my attendance and participation, including the risks described above and other risks that may be known or reasonably foreseeable. I understand that I may withdraw from the event at any time.
Release and waiver of claims
Released Parties. The Released Parties are 5K4Good; Ivey Business School; the City of London; owners and occupiers of the event site and route; participating charities; sponsors; vendors; registration, timing, and service providers; and each of their directors, officers, employees, contractors, volunteers, agents, representatives, successors, and assigns.
TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES from all claims, demands, actions, damages, losses, costs, and liabilities arising from or connected with my attendance or participation, including claims arising from the negligence of a Released Party; a breach of a duty of care, including under Ontario's Occupiers' Liability Act; personal injury, illness, disability, death, or property loss; and first aid, emergency assistance, or medical transportation. This release does not apply to liability that cannot legally be excluded or waived.
Health and emergency assistance
I am responsible for deciding whether I am physically and medically able to participate safely. I will not participate while impaired or if I believe participation would create an unreasonable risk to my health or safety. I will follow reasonable event instructions and stop if I feel unwell or am directed to stop.
If I am injured or become ill, I authorize event personnel to provide or arrange reasonable first aid, emergency transportation, and medical assistance. I understand that 5K4Good does not provide health or medical insurance and that I am responsible for costs not covered by provincial or private insurance.
Photography and media release
I understand that photographs, video, and audio recordings will be taken during the event. I authorize 5K4Good, its sponsors, participating charities, and event partners to photograph, film, or record me and to use, reproduce, edit, publish, and share my image, likeness, and voice for event promotion, sponsor recognition, reporting, fundraising, social media, websites, and other event-related communications, in any medium, without payment. I understand that I may appear incidentally in group or crowd images and that published materials may continue to circulate after the event.
Conduct and legal terms
I am responsible for my conduct and belongings. I will reimburse and indemnify the Released Parties for reasonable losses or claims involving another person or their property to the extent caused by my negligent, reckless, or intentional conduct or material breach of this agreement.
Ontario law and applicable federal law govern this agreement. If any part is invalid or unenforceable, it will be limited or removed only as necessary, and the remainder will continue to apply.
Acknowledgement and signature
By signing below, I confirm that I am at least 18 years old, have read and understood this agreement, understand that it releases claims including claims based on negligence, consent to the photography and media release, and am signing voluntarily. To the extent permitted by law, this agreement binds me and my estate, personal representatives, heirs, and next of kin.
